1. Agreement to these terms
These Terms of Use ("Terms") are a binding agreement between you and Nitzan Biron ("we", "us"), the operator of SkySplit ("the app"). By downloading, accessing or using SkySplit you agree to these Terms. If you do not agree, do not use the app. Our Privacy policy is part of these Terms.
2. Eligibility
You must be at least 13 years old to use SkySplit, and old enough to enter a binding contract where you live. If you use the app on behalf of a group, you confirm you are entitled to enter these Terms for yourself.
3. What SkySplit is, and is not
SkySplit is a tool for recording and splitting shared expenses among people who already know each other, such as friends on a trip. It is a record-keeping and calculation aid.
SkySplit is not a payment service. It never holds, transfers or settles money. It only calculates who owes whom; paying each other happens entirely outside the app and is solely your responsibility. We are not a party to any debt, obligation or dispute between members of a trip.
SkySplit is not financial, tax, accounting or legal advice. Amounts, splits and currency conversions are informational and may be inaccurate, out of date, or rounded. Exchange rates come from a third-party source and are indicative only. Always verify figures yourself before paying anyone or relying on them.
4. Your account
Creating or joining a trip requires signing in, with Google, Apple, or a magic link sent to your email. There is no password to set or remember. Signing in enables sync across devices and trip members. You are responsible for keeping your sign-in method, in particular the email account used for magic links, secure, and for all activity under your account. Tell us promptly if you believe your account has been compromised.
5. Your content
You keep ownership of everything you enter: descriptions, names, amounts, photos and locations ("your content"). You grant us only the limited permission needed to operate the app: to store your content, and to display it to the other members of the trips you put it in. We claim no other rights over it, and we do not use it to train models or for advertising.
You are responsible for your content. You confirm you have the right to share it, including any photo containing other people, and that it is not unlawful. Remember that every member of a trip can see everything entered in that trip.
6. Acceptable use
You agree not to:
- access trips, accounts or data you have not been invited to;
- disrupt, overload, probe or reverse-engineer the service, or attempt to defeat its security or access controls;
- upload unlawful, infringing, deceptive or malicious content, or anything that violates another person's privacy;
- use the app to launder money, defraud anyone, or for any other unlawful purpose;
- resell, rent or commercially exploit the app or scrape its data.
We may suspend or terminate access that breaches these Terms or that puts the service or its users at risk.
7. Third-party services
SkySplit depends on third-party providers, including hosting, authentication, exchange rates, and map and place-search services, as described in our Privacy policy. We do not control those services and are not responsible for their content, availability or accuracy. Your use of the app store from which you obtained SkySplit is also governed by that store's own terms.
8. Availability and changes
SkySplit is provided free of charge, on a best-effort basis. We may change, suspend or discontinue any part of it at any time, and we do not guarantee uninterrupted or error-free operation. Features may be added, altered or removed.
Keep your own records. While the app stores data locally and, when signed in, syncs it to our database, we do not guarantee against data loss. Do not rely on SkySplit as the sole record of anything financially important to you; the app can export your data as CSV and PDF.
9. Ending your use
You may stop using SkySplit at any time, and may delete your account in-app from the You tab (Account → Delete account). Deletion is irreversible and works as described in the Privacy policy: records that form part of a trip's shared history are anonymized rather than removed, so that other members' balances remain correct.
10. Disclaimer of warranties
To the fullest extent permitted by law, SkySplit is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of data, profits, goodwill, or for any amounts owed between you and other members of a trip, or any dispute among them, however caused, and even if we have been advised such damages were possible.
Where liability cannot lawfully be excluded, our total aggregate liability arising out of or relating to the app is limited to the greater of the amount you paid us for the app in the twelve months before the claim (which for a free app is nothing) or USD 50. Nothing in these Terms limits liability that cannot be limited by law, such as for fraud or death or personal injury caused by negligence.
12. Indemnity
You agree to indemnify and hold us harmless from any claim, damage, loss or expense (including reasonable legal fees) arising from your content, your use of the app, or your breach of these Terms, except to the extent it results from our own wrongdoing.
13. Apple App Store
For the iOS app, you acknowledge that these Terms are between you and us only, not with Apple, and that Apple is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, legal or regulatory non-compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
14. Governing law
These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules, and the competent courts of Tel Aviv-Jaffa will have exclusive jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory consumer laws of your country of residence, or of the right to bring proceedings there where the law grants it.
15. General
If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a transfer of the app. These Terms are the entire agreement between us regarding the app.
16. Changes to these terms
We may update these Terms as the app develops. The "last updated" date above always reflects the current version, and material changes will be highlighted in the app. Continuing to use SkySplit after a change means you accept the updated Terms.
